Please take some time to carefully read the following Terms & Conditions to ensure that you understand each provision. By accessing or using the service, you signify that you have read, understood, and agree to be bound by this agreement. If you are not eligible to use the service, or do not agree to the terms and conditions of this agreement, you do not have our permission to use the service

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms & Conditions and neither party has any authority of any kind to bind the other in any respect.

1. Service Description

This Self-Care application is intended for Expresso mobile subscribers. It is a free of charge service allowing users to resolve or ‘self-serve’ some of the simplest queries that typically require to go to a contact center for.

Now with Expresso’s new Self-Care application; you can:

o Manage your account(s),

o Check your balance

o Pay your monthly bill

o Recharge your line

o Check active services and bundles

o Activate bundles and services

o Execute lending transactions: Credit Lending, Data Lending and Voice Lending

o Check your nearest Expresso outlets

o Communicate directly with our customer care

2. Registration

By registering and using the Self-Care Application in any way, you agree to the Terms & Conditions of this service and the operating rules, guidelines and procedures that may be published from time to time on the app by us, each of which is incorporated by reference and may be updated from time to time.

3. Privacy Policy

We are committed to keep your personal information secured and protected. A variety of industry-standard security technologies and procedures are used in order to protect your personal information from unauthorized access, usage, or disclosure. We use practical efforts to protect your personal information, however, no security measure is totally secure, and we cannot guarantee the security of your information.

By accessing or using Self-Care Application, you agree to the gathering of information that you provide us with when you first subscribe to the service. We use this information to keep contact with you and in order to seek your feedback. We may use it later to provide you with information about any future services that we may offer. At any time, you can ask us to adjust or delete the information you have previously shared with us. In addition, we automatically collect information about how you have used Self-Care Application, your schedules, your devices’ operating systems, IP address, etc. We analyze this information to troubleshoot any issues you might encounter, to work out how our products are being used and how to improve them.

This Privacy Policy is subject to occasional revision, and if we make any changes in the way we use your personal information, we will send you a notification. Please note that at all times you are responsible for updating your personal information.

Our terms and policies. Self-Care Application should be used according to our terms and policies. If we disable your account due to any violation, you will not be able to create another account without our permission.

Legal and Acceptable Use . Self-Care Application is used in order to make it easier for subscribers to use Expresso’s offered services. The subscriber will bear any financial and legal resulting from participation in any of the offered services.

Keeping Your Account Secure . You are responsible for keeping your account and device safe and secure. You should inform us of any unauthorized use or security breach of your account or our services by:

In any case, as a service subscriber, you are solely responsible for your compliance with all applicable laws to ensure the legitimate use of Self-Care Services.

4. Registered Intellectual Property Rights

You are not allowed to use our trademarks, logos, IP rights, commercial names, other distinctive features of the marks, or any material subject to copyright or associated with Self-Care Application without our consent.

You are not allowed to remove any information or notices of authorship, ownership of rights or trademarks of Self-Care App.

We are the owners or licensees of all intellectual and industrial property rights related to Self-Care App. The use of Self-Care App does not indicate any assignment of all or part of such rights to you or other service subscribers.

5. Eligibility

The Self-Care App is available for both Postpaid and Prepaid subscribers on Expresso’s network for free.
Self-care is not valid for diverted calls

i. Credit Eligibility

o Self-Care App offer services that requires studying the eligibility of the subscriber in order to offer the most suitable credit offers

o Each eligible subscriber will be able to request credit request for one time before settling the amount lent with an additional 20% (twenty percent) fee.

6. Self-Care App Account

ii. Registering to Self-Care

Registration to Expresso’s Self-Care is free and could be done through Mobile application. The subscriber should fill the full information requested: Mobile Number and Password.

iii. Termination

Any Self-Care request will be available indefinitely or as otherwise notified at the time of purchase, unless:

o The mobile number to which the Self-Care fee is applied is suspended or disconnected.

o We may cancel your subscription immediately in the event you breach these Terms & Conditions.

iv. Consequences of Termination

All the active bundles and services shall remain active.

7. Use of Self-Care

You agree to use the Self-Care services in accordance with these Terms & Conditions and applicable laws, in particular those relating to privacy, image rights, honor and reputation, telecommunications secrecy, protection of personal data, labor relations, non-discrimination and disclosure of secrets.

You will not use the Self-Care Services in any way that may deteriorate the Services, or to provide services to third parties. We own all intellectual property rights to Self-Care and grant you the non-exclusive, limited license to use the Self-Care for personal, non-commercial purposes on your mobile device. All rights not expressly granted to you by this Agreement are reserved.

8. App Permissions

In order to grant full app service functionalities Self-Care will request permissions to the following:

8.1. Push notifications

By clicking allow, you allow Self-Care App to send you push notifications. Notifications may include alerts, sounds, new offers and icon badges. It can be configured in Settings.

8.2. Display over Other Apps

By clicking allow, you allow Self-Care App to show elements of over top and other apps usage (social media and other apps) time spent, and how often you are using them.

9. Indemnification

You agree to indemnify and hold us and our affiliates harmless in connection with any matter related to your misuse or improper use of Self-Care Services to the fullest extent permitted by law.

10. Limitation of Liability

Except to the extent permitted by applicable law: we will not be liable for any indirect loss, including, but not limited to, lost profits, loss of business opportunities, goodwill or reputation, business interruption, computer failure. In any event, our liability will only be for proved direct damages and will be in no event exceeding the total amount you pay as a service subscriber under Self-Care Services in the twelve (12) months prior to the event causing the damage. This limitation will not apply in cases of will-full misconduct or damage directly caused to individuals.

11. Modification

We reserve the right, to modify or replace any of these Terms & Conditions, or change, suspend, or discontinue the Services (including without limitation, the availability of any feature, database, or content) at any time without any prior notice. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. It is also your responsibility to check these Terms & Conditions periodically for changes. Your use of the Services is subject to the Terms & Conditions in effect at the time of such use. We may amend these terms & Conditions from time to time. You shall receive a notification alert through the App whenever an amendment has been made. If, following receipt of such message you continue to use Self-Care App, you will be deemed to have accepted such amendment.

12. Governing Law

These Terms & Conditions shall be governed by the Senegalese law. All disputes, disagreements, controversies, questions or claims resulting from the interpretation, execution, breach, resolution or invalidity of this contract or related to it, directly or indirectly, shall be submitted, with express waiver of the jurisdiction that may correspond to them, to the Court of Senegal. Notwithstanding the above, both parties will do everything reasonably necessary to try to resolve conflicts in an amicable manner.

13. No Waiver

Our failure to enforce any part of these Terms & Conditions shall not constitute a waiver of our right to later enforce that or any other part of these Terms & Conditions. Waiver of compliance in any particular instance does not mean that we will waive compliance in the future. In order for any waiver of compliance with these Terms & Conditions to be binding, we must provide you a written notice of such waiver through one of our authorized representatives.

14. Force Majeure

We shall not be liable for any failure and or delay to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation. In case the Force Majeure Event continues for more than thirty (30) days, then these Terms & Conditions shall be terminated.

15. Warranties

Self-Care Service will be provided in a professional and diligent manner, in accordance with applicable regulations. Any service errors should be notified to our help center. Except for this express warranty, to the maximum extent permitted by applicable law, we make no other warranty, express or implied, regarding Self-Care Services, and you as service subscriber disclaims any warranty of fitness or satisfactory quality of Self-Care Services. We shall have no liability in relation to any failure by Self-Care to restrict or control access to the device on which it is installed and performs all functions identified in it and does not interfere with your intended or desired use of any mobile device. If the App does interfere with your intended or desired use of any mobile device, we shall bear no liability for such interference.
